Terms of Service
Effective date: June 14, 2026
These Terms of Service (“Terms”) govern your access to and use of Evalora, operated by Abhijith Warrier doing business as Evalora, based in Kerala, India (“we”, “us”, or “Evalora”).
By creating an account, joining a workspace, or using any part of the Evalora platform, you agree to these Terms. If you do not agree, do not use the service.
1. The Service
Evalora is a B2B feedback intelligence platform that allows organisations to create feedback forms, run campaigns, collect structured responses from contributors, and analyse results. The service is provided on a subscription basis with a free tier.
We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible. We will not be liable for any modification, suspension, or discontinuation of the service.
2. Eligibility and Account Registration
To use Evalora, you must be at least 18 years old and have the authority to enter into a binding agreement on behalf of yourself or the organisation you represent.
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@evalora.pro if you suspect unauthorised access.
You may not create an account using false information, impersonate another person or organisation, or create multiple accounts to circumvent plan limits.
3. Organisation Owner Responsibilities
When you create a workspace on Evalora, you become the organisation owner. As owner, you:
- Are responsible for all activity within your workspace, including the actions of admins, managers, reviewers, and contributors you add.
- Are responsible for ensuring that your use of Evalora — and your collection of feedback from contributors — complies with applicable laws, including employment law, privacy law, and data protection law in your jurisdiction.
- Must inform contributors that a webcam image will be captured and stored as part of every feedback submission, as webcam capture is a core and mandatory feature of the Evalora platform. Evalora does not manage this disclosure on your behalf.
- Are responsible for ensuring that the join link for your workspace is not shared with unauthorised individuals.
4. Acceptable Use
You agree not to use Evalora for any of the following:
- Collecting feedback in a way that violates the privacy or dignity of respondents
- Using Evalora to capture webcam images of individuals without first informing them that webcam capture is part of the submission process
- Harassment, intimidation, or coercion of contributors to submit responses
- Distributing malware, spam, or harmful content through the platform
- Attempting to reverse-engineer, scrape, or extract data from the platform beyond what is available through our official export features
- Circumventing plan limits through technical means or multiple accounts
- Using Evalora in any way that violates applicable local, national, or international law
We reserve the right to suspend or terminate accounts that violate these rules, without prior notice in cases of serious violations.
5. Subscription Plans and Payment
Plans
Evalora offers a free Starter plan and paid Pro and Institution plans. The features and limits of each plan are described on the pricing page. We reserve the right to change plan pricing and features with 30 days' notice to existing subscribers.
Current availability
Paid plan billing is not yet active. At this time, all workspaces operate on the Starter plan by default. Pro and Institution plans are available by contacting us directly at support@evalora.pro. This section will be updated with full billing terms when self-serve payment is introduced.
Plan limits
Plan limits — such as the maximum number of responses per campaign, forms, campaigns, and members — are enforced by the platform. If your usage reaches a plan limit, the affected feature will be paused until you upgrade your plan. We will not charge overage fees.
6. Data Ownership
Your data belongs to you
All feedback forms, campaigns, and responses created in your workspace are your organisation's data. We do not claim ownership of your content. You may export your data at any time using the export features in the platform.
How we use your data
We process your data only to provide and improve the Evalora service. We do not sell your data, use it for advertising, or share it with third parties beyond the processors listed in our Privacy Policy.
AI features
When you use the AI summary feature, the following is sent to the Anthropic Claude API: the organisation name, campaign titles, question text, and text-based answer values from submissions across the organisation. No individual user names or email addresses are included. This feature is optional — if you do not use it, no response data is shared with Anthropic.
Data deletion
There is no self-service workspace or account deletion in the platform. To request deletion of your workspace and all associated data — forms, campaigns, responses, and media — contact us at support@evalora.pro. Workspace deletion is permanent and irreversible. We recommend exporting your data before requesting deletion.
7. Intellectual Property
Evalora and all associated software, design, trademarks, and content are owned by Abhijith Warrier (operating as Evalora) and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Evalora platform without our express written permission.
You retain all rights to the content you create — forms, questions, and feedback data. By using Evalora, you grant us a limited, non-exclusive licence to store, process, and display your content solely to provide the service to you.
8. Confidentiality of Feedback
Feedback submitted by contributors is visible only to authorised members of your organisation based on their role. Evalora does not disclose response data to other organisations, and our staff do not access workspace data except in response to a verified support request from an organisation owner or as required by law.
You are responsible for configuring access appropriately within your workspace and for informing contributors of who can see their responses.
9. Disclaimer of Warranties
Evalora is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. We do not warrant that any data you store on Evalora will be retained indefinitely or recovered in the event of a failure.
You use the service at your own risk. We strongly recommend maintaining your own backups of critical data by exporting it regularly.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Evalora and Abhijith Warrier shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunity — arising out of or related to your use of or inability to use the service.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the 3 months preceding the claim, or (b) ₹1,000 (one thousand Indian rupees).
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Evalora and Abhijith Warrier from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the service in violation of these Terms
- Your violation of any applicable law or third-party rights
- Your failure to inform contributors that webcam images are captured and retained as part of every Evalora submission
- Content you submit or the data your organisation collects through the platform
12. Termination
By you
You may stop using Evalora at any time. There is no self-service account or workspace deletion. To request termination and removal of your data, contact us at support@evalora.pro.
By us
We may suspend or terminate your access if you violate these Terms, if required by law, or if your account is involved in fraud or abuse. For non-serious violations, we will attempt to give you notice and an opportunity to remedy the issue before terminating your account. For serious violations (illegal activity, data abuse), we reserve the right to terminate immediately.
Effect of termination
On termination, your right to use the service ceases. Sections covering data ownership, intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or your use of Evalora shall be subject to the exclusive jurisdiction of the courts of Kerala, India.
Before initiating any legal proceeding, you agree to first contact us at support@evalora.pro and give us 30 days to attempt resolution in good faith.
14. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the new Terms take effect. Minor clarifications may be made without notice.
Continued use of Evalora after updated Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the service before they take effect.
